O R D E R
1. By filing this transfer petition under Section 25 of the Code of Civil
Procedure, 1908, the petitioner-wife seeks transfer of Matrimonial Case No. 359
of 2023 titled “Sandeep Malik vs. Smt. Preeti”, pending before the Principal
Family Court, Shamli-Kairana, District Shamli, Uttar Pradesh to the Principal
Family Court, Karkardooma Court, Shahdara, Delhi.
2. We have heard learned counsel appearing for the parties.
3. It appears that both the petitioner-wife and the respondent-husband are
presently working in Moradabad, Uttar Pradesh. In fact, vide grounds “G” and
“H” of the transfer petition, the petitioner-wife has urged that it would be very
difficult for her while working in Moradabad to travel all alone to Shamli-Kairana
to attend the Court hearing on daily basis.
4. Having regard to the fact that places of work of both the parties are the
same, we consider it fit and proper to transfer, in exercise of power conferred
by Article 142 of the Constitution, Matrimonial Case No. 359 of 2023 titled
“Sandeep Malik vs. Smt. Preeti” from the Principal Family Court, Shamli-Kairana,
District Shamli, Uttar Pradesh, to the Principal Family Court, Moradabad, U...
