Despite service of notice, none appears for the respondent.
Leave granted.
The learned counsel appearing for the appellant states that
the suit is still pending. In our view, as the suit is pending,
interests of justice will be served if the interim order dated
20th September, 2021 of this Court is continued till the disposal of
the suit. The interim order dated 20th September, 2021 reads thus:
“... In the meanwhile, the respondent is restrained from
alienating or creating any third party rights over the subject property in question, i.e. “Agam Residency-F, 2nd Floor, Flat No. F-204, Near Reliance Mart, Vesu, Surat, Gujarat”, until further orders.”
Accordingly, we direct that the aforesaid interim order will
continue to operate till the disposal of the suit.
All contentions of the parties on the merits of the suit are
kept open.
The Appeals are disposed of accordingly.
