1. Leave granted.
2. This appeal arises from the judgment and order passed by
the High Court of Karnataka, Kalaburagi Bench in Regular First
appeal No. 200088 of 2018 dated 11th June, 2024 by which the
First Appeal filed by the appellant herein (original
defendant) against the judgment and decree dated 6th June, 2018
of specific performance passed by the Senior Civil Judge and
JMFC at Sindhanur in Original Suit No. 232 of 2014 instituted
by the respondent herein (original plaintiff) came to be
dismissed.
3. For the sake of convenience, the appellant herein shall
be referred to as the original-defendant and the respondent

herein shall be referred to as the original-plaintiff.
4. The plaintiff instituted Original Suit no. 232 of 2014 in
the Court of Senior Civil Judge and J.M.F.C. at Sindhanur for
specific performance of contract based on an agreement of sale
in respect of suit land bearing survey no. 34/*/6 at
measuring 4 acre 9 guntas instituted at K. Basssapur village,
Taluk Sindhanur.
5. The suit came to be allowed by the trial court.
