1. Leave granted.
2. Heard learned counsel for the parties and perused
the record.
3. Having regard to the peculiar facts and
circumstances of the instant case, whereby it is clear
that not only has the respondent served the appellant-
bank for 34 years, but also that no serious allegation of
corruption or embezzlement has been proved against him,
we are not inclined to interfere with the impugned
judgment of the High Court dated 12.05.2023, whereby the
punishment of removal from service has been reduced to
that of compulsory retirement of the respondent.
4. The appeal is, accordingly, dismissed.
5. However, it is clarified that the above-stated

order has been passed in the particular facts and
circumstances of this case, and that this order shall not
be treated as a precedent for other cases.
