ORDER
1. The petitioner-wife has filed the present petition under Section 25 of the Code of Civil
Procedure, 1908 seeking transfer of a petition for divorce filed by the respondent-
husband under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 bearing HMA
No.1852 of 2023 titled “Roop Kant Vs. Priyanka Yadav ” pending before the Court
of Judge, Family Court (North-West), Rohini, Delhi to a Court of competent
jurisdiction/ Family Court, District Fatehpur, Uttar Pradesh.
2. Though service of notice on the respondent is complete, no one has entered
appearance on his behalf. Even today, the respondent remains unrepresented.
3. Having heard learned counsel for the petitioner-wife and on examining the grounds
taken in the transfer petition, we direct transfer of HMA No.1852 of 2023 titled “Roop
Kant Vs. Priyanka Yadav ” pending before the Court of Judge, Family Court (North-
West), Rohini, Delhi to a Court of competent jurisdiction/ Family Court, District
Fatehpur, Uttar Pradesh.
4. The record of the case be transferred immediately to the transferee Court.
