O R D E R
The present special leave petition has been preferred
against the order dated 12.09.2014 passed by the High Court
remanding the matter to the Land Tribunal, Arasikere for fresh
consideration.
Mr. Girish Ananthamurthy, learned counsel for the
petitioner submitted that his client was inducted on the land
by virtue of a registered lease deed executed on 02.10.1967 by
one Mr. K.Y. Venkatasubbaiah. In terms of the Karnataka
Village Offices (Abolition) Act, 1961, re-grant was made by
the concerned authority on 02.06.1979 and, as such, the lease
deed executed in favour of his client must be given full
effect.

It was further submitted that in terms of the mandate
under the Karnataka Land Reforms Act, 1961, the right of a
lessee must fructify into full ownership of the land.
Since the matter has been remanded by the High Court, we
do not think it appropriate to entertain these submissions at
this stage but give liberty to the petitioner to raise all
such submissions before the authority to which the proceedings
now stand remanded.
The special leave petition stands disposed of, in
aforesaid terms.
