Leave granted.
Heard the learned counsel appearing for the
appellants, the learned counsel appearing for the first
respondent-State and the learned counsel appearing for
the second respondent. The second respondent is the
first informant who lodged the First Information Report
on 18th July, 2019 alleging the commission of the offences
punishable under Section 363 and 366A of the Indian Penal
Code (IPC), 1860. A charge-sheet was filed for the
offences punishable under Sections 212, 363, 366-A,
376(2)(n), 376(3) and 120-B of the IPC. The date of
birth of the second appellant (alleged victim of the
offence) is 6th August, 2003. In the first Information
Report, the second respondent stated that, at the
relevant time, the second appellant was studying in 11th
standard who was abducted by the first appellant with the

intention of marrying with her. He stated that the act
of abduction took place in the intervening night of 17th
and 18th July, 2019.
