Leave granted.

The occurrence in question is dated 03.06.2022. There are

cross First Information Reports (FIRs).

Our attention is drawn to the nature of injuries suffered. It

is stated that the other side did not suffer any fracture. Most of

the injuries are simple in nature.

The chargesheet has been filed and the appellants, namely,

Milan Mandal, Prem Lal Mandal and Parul Devi were not arrested

earlier in terms of order passed by the High Court and, thereafter,

by this Court.

In view of the facts and circumstances of the case, we accept

the present appeal and direct that in the event of the appellants –

Milan Mandal, Prem Lal Mandal and Parul Devi being arrested in

connection with FIR No. 51 of 2022 dated 05.06.2022 registered with

Police Station – Barhait, District – Sahibganj, Jharkhand for the

offence(s) punishable under Sections 341, 307, 323, 325, 379, 504,

506 and 34 of the Indian Penal Code, 1860, they shall be released

on bail by the arresting/investigating officer/trial court on terms

and conditions to be fixed by the trial court.

In addition, the appellants – Milan Mandal, Prem Lal Mandal

and Parul Devi shall comply with the conditions mentioned in

Section 438(2) of the Cod...
