1. Leave granted.
2. Heard learned counsel for the parties.
3. The present appeal has been filed by the appellant –
Parameshwarappa challenging the impugned order dated
01.06.2023 passed by the High Court of Karnataka at
Bengaluru in Criminal Appeal No.242 of 2012, whereby the
High Court has allowed the said appeal in part and modified
the judgment and order passed by the Sessions/Trial Court.
4. The Sessions/Trial Court had found the appellant
guilty for the offence under Section 307 and imposed
punishment to undergo imprisonment for a period of seven
years; and also held guilty for the offence under Section
341, for which the sentence imposed was one month and for
the offence under Section 504, imposed punishment for one
year.
5. The High Court vide the impugned judgment has
modified the said order and held the appellant guilty for
the offence under Section 325 of IPC and directed to

undergo imprisonment for a period of three years and to pay
fine of Rs.50,000/-, in default, thereof, to undergo simple
imprisonment for a period of six months for the said
offence. The sentence passed by the Trial Court for the
