The learned counsel appearing for the respondent seeks time.
On 6th September, 2024, notice was issued. The notice was
served on 1st October, 2024. On 21st October, 2024, time was sought
by the respondent. Though the notice was served 20 days back, we
granted time of one month to the respondent to file a counter
affidavit. In the meanwhile, the appellant has filed two
affidavits. The first affidavit is affirmed on 19th October, 2024
wherein it is recorded that the appellant has joined the
investigation on the three dates mentioned therein and he has
submitted the documents, a list of which is incorporated in
paragraph 3. In the second affidavit dated 26th November, 2024, the
appellant has stated that he has attended the investigation on the
three dates mentioned in paragraphs 5 to 7 and has produced various
documents which are mentioned in the letter dated 21st November,
2024.
The respondent had more than sufficient time to file a counter
affidavit.
