O R D E R
1. Heard learned senior counsel appearing for the
appellant.
2. We concur with the view taken by the National Company
Law Appellate Tribunal (NCLAT) that the appeal against
order dated 2nd May, 2023 was barred by limitation.
Therefore, we dismiss the appeal.
3. Our attention is invited to the fact that the
appellant has preferred a separate appeal against an order
dated 17th August, 2023 which is pending before the NCLAT.
We make it clear that the observations made in the impugned
order will not affect the merits of the pending appeal and
the same shall be decided on its own merits.
4. All contentions in the pending appeal are kept open.
5. Pending application(s), if any, shall stand disposed of.
