2. Heard Mr. Krishna Pal Singh, learned counsel appearing for the

appellant and Mr. R.K. Singh, learned counsel, appearing for the

respondent no.1. The State of Uttar Pradesh is represented by Mr.

Ankit Goel, learned counsel.

3. This is an inter se seniority dispute between the appellant

and the respondent no.1. The learned counsel for the appellant

refers to the proceedings dated 16.12.2020 in Special Appeal D

No.1267/2020 to point out the appellant was arrayed therein as the

respondent no.4 but no hearing was afforded by the Court, while

allowing the said Special Appeal, filed by the respondent no.1. It

is then submitted that a recall application was filed and in the

accompanying affidavit, it was specifically pleaded that although

mention of the case before the Division Bench was made by the other

side, the counsel for the present appellant was never informed.

That is why the respondent no.4 went unheard and unrepresented in

the said proceedings before the Division Bench on 16.12.2020.
