2. We have heard learned senior counsel and learned
counsel appearing for the respective parties and perused
the material on record.
3. During the course of submissions, it was brought to
our notice that it is only the respondents herein/one

Doctor and 38 nurses, who are continuing in service in
the College, which is now a Government College. It was
taken over by the State Government by virtue of order
dated 17.12.2013.
4. Learned senior counsel appearing for the State
submitted that it would be difficult to give effect to
the directions issued by the High Court as well as Kerala
Administrative Tribunal (KAT) inasmuch the aforesaid
persons have been working only on contract basis/daily
wage basis; that there cannot be any retrospective
