1. Leave granted.
2. The present appeal arises out of the impugned judgment
and order dated 04.07.2023, passed by the High Court of
Madhya Pradesh at Gwalior in Misc. Criminal Case
No.21390/2023, whereby the High Court has allowed the said
petition filed by the respondent no.2-accused seeking
quashing of the F.I.R. registered as Crime No. 132/2023 at
Police Station-Kampoo, District-Gwalior (M.P.) for the
offence punishable under Sections 376,376(2)(b), 376(2)
(n),354 and 506 of the Indian Penal Code, and has quashed
the F.I.R. as well as the consequential proceedings arising
from the said F.I.R. and discharged respondent no.2 from the
case.
3. Heard learned counsel for the parties and perused the
material on record.
4. It is not disputed by the learned counsel for the
parties that the investigation in the present case is over
and the charge-sheet has also been filed before the
concerned Court against the respondent no.2-accused for the
