UPON hearing the counsel the Court made the following O R D E R
While we agree with the High Court that the petitioner herein
is ‘State’ within the meaning of Article 12 of the Constitution of
India, however, we are inclined to issue notice on the findings
recorded in the impugned order setting aside the penalty on merits.
There will be a stay on operation of the impugned order till the
next date of hearing.
