O R D E R
1. Our last order dated 4-12-2025 reads thus:-
“1. Mr. Anand Varma, the learned Amicus has taken pains to prepare a very exhaustive note giving us more than a fair idea as regards the facts of the two suits, the position of law, more particularly, the inter-play between Section 10 of the Civil Procedure Code and Section 25 of the Code respectively.
2. After hearing the learned counsel appearing for the petitioner and the Amicus, we brought to the notice of the learned counsel for the petitioner that if the suit is transferred from Karnataka to Madras, then the two suits will have to be consolidated and common evidence would have to be led. We had to bring this fact to the learned counsel because the suit instituted by the petitioner namely C.S. No.427/2015 titled “Hindustan Unilever Limited vs. Roopa Industries & Anr.” is at the final stage of arguments. Perhaps the consolidation may delay the final adjudication of the suit instituted by the petitioner.
3. In such circumstances, we want the learned counsel to seek appropriate instructions from his client and come back to us.
