During the course of submissions it is brought to our
notice that the resolution plan has been approved by the
National Company Law Tribunal (for short ‘the NCLT’), Kolkata
Bench, by order dated 16.12.2021
In the light of change in circumstances, Mr. Mukul
Rohatgi, learned Senior Advocate for the appellant on
instructions submits that he may be permitted to withdraw the
instant appeal with liberty to challenge the order passed by
the NCLT dated 16.12.2021 along with the ground being raised
by him in the instant appeal.
The appeal is dismissed as withdrawn with liberty as
prayed for.
Pending application(s), if any, also stand disposed of as
withdrawn.
