IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION

CRIMINAL APPEAL NO. OF 2024 [arising out of SLP (Crl.) No.10163/2024]

MD.RIZWAN Appellant

VERSUS

THE STATE OF BIHAR & ANR. Respondents

O R D E R

1. Leave granted.

2. By the impugned order dated 29th February, 2024, the High Court

has rejected the appellant’s prayer for bail in anticipation of arrest.

3. We have heard learned counsel appearing for the appellant as

well as the respondent-State of Bihar and perused the materials

available on record.

4. The appellant figures as an accused in FIR No.285/2023 dated

18th June, 2023 registered with Police Station Bikram, Paliganj, Distt.

Patna. It is alleged in the FIR that the appellant, with ulterior motives,

has changed entries in land records once his demand for bribe was not

met by the complainant and, accordingly, has committed offence(s)

punishable under Sections 166-A, 167, 420, 468, 471, 120-B, 323, 504

read with Section 34 of the Indian Penal Code, 1860.

5. It appears from the counter affidavit of the respondent-State of

Bihar that the appellant has responded to the notice issued under

Section 41-A of the Code of Criminal Procedure, 19731 and joined

investigation. It is further not disputed that documents allegedly
