Leave granted.

2. Heard Mr. Balaji Srinivasan, learned counsel appearing

for the appellant (defendant). Also heard Mr. K.

Radhakrishnan, learned Senior Counsel representing the

respondent nos.1 to 4 (Plaintiffs).

3. The appellant was allotted ceiling surplus land by the

Government of Tamil Nadu through the order dated 24.03.1994

(Annexure P-2). The person who encroached in the allotted land

had filed Writ Petition No.18278 of 2015 to assert his right

and the said proceeding is pending before the High Court. It

is accordingly submitted by the leaned counsel representing

the government authorities that the present matter be remitted

back to the High Court to be adjudicated analogously with the

Writ Petition No.18278/2015.

4. The above suggestion is acceptable to Mr. Balaji

Srinivasan, learned counsel appearing for the appellant.

5. Accordingly, the impugned order of the High Court dated

18.08.2022 in WP(C) No.21317 of 2022 is set aside and quashed.

The matter is remanded back to the High Court for analogus

adjudication with the Writ Petition No.18278 of 2015. The
