1. Heard learned senior counsel/counsel for the parties.
2. The appellant has challenged the order dated 31.08.2021
passed by The National Consumer Disputes Redressal Commission
(hereinafter called “the NCDRC”). A consumer complaint was
filed by the Respondent/Complainant (Home buyer-Sanjay
Gopinath) before the NCDRC stating that he is a home buyer and
had purchased an apartment from the appellant which was to be
completed within a period of 42 months plus the grace period of
six months and for the same, a certain amount was also given to
the appellant- builder. As per the terms of the agreement
between the two, the possession of the apartment was to be
handed over to the consumer by November 2018. Since this was
not done, the respondent moved a complaint before the NCDRC and
