Learned counsel appearing for the respondent (husband) states
that an application has already been moved to withdraw H.M.A.
Petition No.1649 of 2022 titled “Sh. Naveen Kumar vs. Smt. Pooja
Seth” filed by the respondent (husband) under Section 9 of the
Hindu Marriage Act, 1955 seeking restitution of conjugal rights. He
further states that the said petition shall be withdrawn by the
respondent on the next date of hearing, i.e., 20122022.
In this view of the matter, the Transfer Petition has become
infructuous and is disposed of accordingly.
However, liberty is given to the petitioner (wife) to seek
revival of this Transfer Petition, if need be in future.
