O R D E R
1. By way of this petition filed under Section 25 CPC, the
petitioner - wife seeks transfer of the petition filed by the
respondent – husband being Matrimonial Case No. 33 of 2024 titled
“Bikash Kumar Behera vs. Priyanka Nath” under Section 13 (b) of the
Hindu Marriage Act,1955, pending before the Court of Principal
Senior Civil Judge at Karwar (Karnataka) to the Competent
jurisdictional Family Court at Keonjhar, Odisha.
2. The respondent-husband, although served with the notice issued
by this Court yet has chosen not to remain present before this
Court either in-person or through an advocate.
3. Sufficient cause having been made out by the petitioner –
wife, warranting transfer of the case, as prayed for by her, the
Transfer Petition deserves to be allowed. It is ordered
accordingly.
4. Consequently, Matrimonial Case No. 33 of 2024 titled “Bikash
Kumar Behera vs. Priyanka Nath” pending before the Court of
Principal Senior Civil Judge at Karwar (Karnataka) is ordered to be
transferred to the Competent jurisdictional Family Court at
Keonjhar, Odisha.
