1. Leave granted.

2. Having heard the learned counsel for the parties, we are of the considered view

that the Second Appeal bearing No.0761/2017 titled Bandu Shivala Gangurde & Ors.

vs. Smt. Hirabai Babulal Bagul (Konkani) pending before the High Court of Judicature

at Bombay (Aurangabad Bench) can be disposed of, which would be in the best

interest of justice as also the parties, on the following terms :

(a) Since the High Court has admitted the appeal and issued notices

to the respondents therein (one of them is the appellant herein and rest

are the respondents in the present appeals), the appeal be taken on

board and heard expeditiously;

(b) The present appellant and the respondents who are the

respondents in the High Court undertake to enter appearance in the said

appeal;

(d) The parties shall appear before the High Court on 14.01.2025 and

undertake to fully cooperate in the hearing of the appeal.

(e) Till the appeal is disposed of by the High Court, the parties shall

maintain status quo with regard to possession and title, as on date.

3. We request the High Court to take up the appeal and decide the same

expeditiously, preferably within a period of six months from today.
