O R D E R
1. Heard Mr. Gaurav Gupta, learned counsel appearing for the
petitioner (wife). Also heard Ms. Inklee Roy, learned counsel
appearing for the respondent (husband).
2. The Mediation proved to be unsuccessful and accordingly this
transfer petition is listed in Court.
3. The two children born to the couple are staying with the
petitioner and she is residing in her parental home at Delhi. Her
mother is undergoing cancer treatment.
4. The respondent’s counsel however submits that the petitioner
has income on her own and therefore this transfer petition should
not be considered.
5. Having considered the circumstances here and more particularly
the fact that both minor children are in the care of the mother, we
allow the transfer petition. The Petition A/502/2024 titled
“Akshay Vinay Jain v. Ankita Akshay Jain”, pending before the
Family Court No. 4, Pune, Maharashtra is directed to be transferred
to the Principal Judge, Family Court, Saket, New Delhi.
6. Records of the case would be immediately transferred to the
transferee court.
7. The parties are directed to appear, either in person or
through an authorized representative before the transferee court.
