O R D E R
1. Leave granted.
2. The present appeal has been preferred by appellant/convict
assailing the order dated 31.01.2023 passed by Punjab and
Haryana High Court in CRR – 3439-2018 (O&M) maintaining the
judgment of conviction dated 26.09.2018 passed by Court of
Sessions, Narnaul, Haryana for offence under Section 304-A of
Indian Penal Code (in short ‘IPC’). The Sessions Court in appeal
set-aside the judgment of acquittal passed by Trial Court and
directed the appellant to undergo the sentence of simple
imprisonment for six months and pay fine of ₹1,00,000/-. The fine
was payable as compensation to the victim under Section 357 of
the Code of Criminal Procedure, 1973. Aggrieved against the
judgment of the 1st Appellate Court, Criminal Revision was

preferred by the appellant before the High Court, which was
dismissed vide the impugned judgment. Hence, the present
appeal.
3. After hearing the learned counsels for the parties and on perusal
of the findings as recorded by the Appellate Court and the High
Court, we are satisfied that conviction for the charge proved under
Section 304-A of the IPC, has rightly been directed against the
