Leave granted.
2. Heard Mr. Anil Nag, learned counsel appearing for the
Appellant(s).
3. The Office Report dated 19.11.2024 indicates that notice
was duly served on the respondent, who was the writ petitioner
before the High Court. But none has entered appearance on her
behalf.
4. The matter pertains to correction of Date of Birth (DoB)
of the respondent who was given compassionate appointment, in
a Grade IV post, on 08.08.1990. In the service records, the
respondent’s DoB was recorded as 10.12.1956 which was later
changed to 10.12.1958 as seen in the bio-data proforma
(Annexure P-3). But on the eve of her retirement in 2018, the
respondent filed the OA No.7543 of 2018 before the State
Administrative Tribunal Himachal Pradesh, for correction of
her DoB in the service record. In support of the said claim,
the birth certificate issued by Gram Panchayat, Sagnam was

enclosed where the respondent’s DoB is reflected as
10.12.1960.
5. When the Tribunal was abolished, the OA was transferred
to the High court and under the impugned judgment dated
