O R D E R

This petition is filed under Section 25 of the Code of

Civil Procedure seeking transfer of divorce case, being Mat.

Suit No. 1578/2022, titled “Mohanlal Parmar vs. Sangeeta

Parmar“ pending before the Court of 14th Addl. District Judge

at Alipore, West Bengal to the Family Court, Kutch, Gujarat.

Despite service of notice, the respondent has chosen not

to appear and contest the matter. Heard learned counsel for

the petitioner and perused the materials available on record.

On such consideration, we are of the view that the

transfer can be allowed. Consequently, the Transfer Petition

is allowed.

Accordingly, the divorce case, Mat. Suit No. 1578/2022,

titled “Mohanlal Parmar vs. Sangeeta Parmar“ pending before

the Court of 14th Addl. District Judge at Alipore, West Bengal

is transferred to the Family Court, Kutch, Gujarat.

The Court of 14th Addl. District Judge at Alipore, West

Bengal shall transfer the entire records pertaining to the

said case to the transferee court expeditiously.

The Respondent-husband is permitted to attend the

proceedings virtually, unless his presence is inevitable and

required by the Trial Court.
