O R D E R
1. Leave granted.
2. The appellant is aggrieved by an order dated
02.08.2022 passed by the Gujarat High Court in a civil
appeal arising out of a civil suit in which the issue
that arose for consideration was whether the appellant is
not a citizen of India and if so whether he is entitled
to the grant of such citizenship?
3. The appellant’s case is that he was born at Godhra,
Gujarat in 1962. The entire family migrated to Pakistan
in the year 1976. The appellant claims to have returned
to India in 1983 and got married to Sakina Kurbanhusain
Dalal on 02.03.1984. He continued to visit Pakistan
frequently till he eventually returned to India in 1991
after obtaining requisite permits, including a resident
permit.
4. The appellant claims that he and his family are
Indian citizens. Under the fear that he may be deported
from the country, the appellant filed a civil suit
seeking a declaration of being a citizen of India under

Section 5(1)(c) of the Citizenship Act, 1955 which has
been dismissed concurrently.
5. When the matter came up for hearing on 23.09.2022
status quo re: deportation of the appellant was directed
