1. Leave granted.
2. Heard Mr. S. Mahendran, learned counsel appearing for the
appellant. The State of Tamil Nadu is represented by Mr. Amit
Anand Tiwari, learned A.A.G. The respondent No. 2 is represented
by Mr. Deepayan Mandal, learned counsel.
3. The challenge here is to the order dated 08.07.2022 in the
W.P. No. 5840 of 2017 whereunder the Madras High Court dismissed
the appellant’s Writ Petition. The challenge in the Writ Petition
was to the order dated 29.12.2016 whereby, the appellant’s claim
for two advance increments for his ML Degree, in light of the G.O.
dated 24.04.1979, was rejected on the ground that the benefit of
the advance increment for acquiring the ML degree will apply only
for officers in the cadre of Assistant Registrars and above, in the
High Court service.
4. The appellant’s counsel would however advert to the G.O. dated
24.04.1979 to claim that the benefit of advance increment under the
said G.O. for persons with ML degree was not restricted to any
specific post held by the concerned employee.

5. However, it is seen that the appellant at the relevant time
was serving as the Section Officer in the Madras High Court
