Leave granted.

This appeal is against the judgment and order dated 12.03.2018

passed by the High Court of Karnataka at Bengaluru dismissing

Criminal Appeal No. 780 of 2012 against an order of conviction and

sentence dated 26.06.2012 passed by the 4th Additional Sessions

Judge, Mysuru in Sessions Case No. 253/2008.

The appellant has been convicted under Section 506 of the

Indian Penal Code and sentenced to imprisonment of 6 months. By an

order dated 10.08.2018, this Court issued notice as to whether the

appellant can be given benefit of the Probation of Offenders Act,

1958.

An interim order was passed extending the exemption granted to

the appellant from surrendering. The complainant is the wife of

the appellant. It is stated that the appellant and the complainant

have compromised their differences and arrived at a settlement.

The offence for which the appellant has been convicted

is punishable with imprisonment upto two years. The appellant has

been sentenced to imprisonment for six months, as stated above.
