1. Leave granted.
2. A Division Bench of the High Court of Punjab and
Haryana at Chandigarh, by the impugned judgment and
order dated 28th March, 2023, declined to condone the delay
of more than 600 days in presentation of a Letters Patent
Appeal (LPA) No.882/2017 by the State of Haryana from the
judgment and order dated 24th July, 2015 of a learned Single
Judge of the Court in CWP No.23074/2010 (Rampal Patwari &
Ors. v. State of Haryana & Anr). The said order is challenged
in this appeal.
3. We find from the records that by the order of the
learned Single Judge dated 24th July, 2015, as aforesaid, not
only was the writ petition filed by Rampal Patwari and others
allowed but another writ petition filed by Parmanand and
others, being CWP No.15880/2013, also stood allowed.
4. The State of Haryana went up in appeal against the
order dated 24th July, 2015 passed on the writ petition of the
said Parmanand and others, which is LPA No.1865/2015.
Initially, notice was issued on 15th July, 2016 and operation of
the impugned order was stayed. Finally, by an order dated
18th February, 2020, delay was condoned and the appeal set
down for hearing on 23rd April, 2020. Howeve...
