At the commencement of hearing, learned counsel for the
appellant submits that the parties have arrived at an out of Court
settlement and the Deed of Settlement dated 31.10.2019 (Annexure P-
3) has already been filed by the parties. Learned counsel for the
respondents supported the aforesaid submission.
In view of the above, we set aside the order passed by
the trial court as upheld by the High Court. The aforesaid
settlement deed is taken on record.
The appeal is accordingly allowed.
As a sequel to the above, pending interlocutory
application also stands disposed of.
