Heard learned counsel for appellant and perused the averments
as contained in the Miscellaneous Application.
For the reasons indicated therein and also taking into
consideration the fact that in view of the arrangement between the
parties, an adjudication on merits was not necessitated and the
civil appeal was disposed of. In those terms, the appellant is
entitled to refund of the Suitor’s fund amount of Rs.50,000/-.
