1. Delay condoned.
2. These two transfer petitions are at the instance of
the petitioner-husband seeking transfer of (i) CRMA-J
No.939/2023, titled “Nimisha V. Rastogi vs. Pradeep K.
Chavda”, filed by the respondent-wife under Section 125 of
the Code of Criminal Procedure, 1973 (in short, the
“Cr.P.C.”) and (ii) CRMA No.1078/2023, titled “Nimisha V.
Rastogi vs. Pradeep K. Chavda”, filed by respondent-wife
under Sections 12, 18, 19, 20, 22, and 23 of the
Protection of Women from Domestic Violence Act, 2005 (in
short, the “D.V. Act”), which are pending before the
Family Judge, Ahmedabad, Gujarat & Judicial Magistrate
First Class, Ahmedabad, Gujarat, respectively. The
petitioner-husband seeks transfer thereof to the Family
Court, Mumbai Maharashtra and Court of Judicial Magistrate
