Heard Mr. Varun Dev Mishra, learned counsel appearing

for the petitioner (wife). Also heard Ms. Shagufa Salim,

learned counsel appearing for the respondent (husband).

2. The mediation proved to be unsuccessful and accordingly

the Transfer Petition is taken up for consideration.

3. The petitioner is residing in her parental home at

Sikar, Rajasthan. The claim for maintenance under Section

125 of the CrPC filed by the petitioner against the

respondent as also her complaint under the Protection of

Women from Domestic Violence Act of 2005 and the complaint

under Section 498A and other penal provisions are all

pending before the forums at Sikar, Rajasthan. In these

three proceedings, the respondent, in any case, has to

appear and contest.

4. Having considered the above, we deem it appropriate to

order transfer of the Divorce Petition HMA/139/2024 titled

"Wg Cdr Umesh Kumar V. Pratibha”, pending before the

District and Sessions Court, Chandigarh, to the District and

Sessions Court, Sikar, Rajasthan. It is ordered

accordingly.
