O R D E R
Though I.A.No.4466 of 2021 seeking certain directions is
listed today, with the consent of both the parties, the appeal
itself is taken up for hearing.
This appeal arises out the judgment and order dated 23.04.2015
passed by the Division Bench of the High Court of Judicature at
Calcutta in APO No.247 of 2014.
While disposing of the appeal, the Division Bench passed the
following operative direction:
"Ends of justice would be sub-served, if we limit the punishment for one year so that after one year he would be restored to his own position that was prevalent immediately before passing of the order of the disciplinary authority."
The appeal arising from the decision of the Division Bench has
been pending in this Court for the last five years. At the interim
stage no stay was granted, as a result of which the operative

direction issued by the Division Bench has worked itself out.
In the circumstances, we see no reason to interfere in the
matter.
The Civil Appeal is dismissed with no order as to costs.
