IN THE SUPREME COURT OF INDIA
CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO. OF 2025 (arising out of SLP(Crl.) No. 17208/2025)
ARUL PRASANTH APPELLANT(S)
VERSUS
THE STATE REP. BY INSPECTOR OF POLICE
RESPONDENT(S)
O R D E R
Leave granted.
The appellant, Arul Prasanth, is
aggrieved by the judgment and final order
dated 04.09.2025 passed by the High Court
of Judicature at Madras in Criminal O.P.
No. 11874/2025 denying him regular bail in
connection with First Information Report
(FIR) No. 54 dated 07.11.2024 registered
with Police Station – NIB-CID, Chennai,,
District – Chennai, Tamil Nadu, for the
offences punishable under Section 8(c)
1
read with Sections 20(b)(ii)(C), 25 and
29(1) of the Narcotic Drugs and
Psychotropic Substances Act, 1985.
Counter affidavit/reply having been
filed by the State, we find that the
appellant, Arul Prasanth, has no past
antecedents. The co-accused, Prakash, has
already been granted regular bail by the
High Court.
We, therefore, find no grounds to
continue with the pre-conviction
incarceration of the appellant, Arul
Prasanth, at this stage.
The appeal is accordingly allowed,
setting aside the impugned judgment/order
passed by the High Court.
The appellant, Arul Prasanth, is
directed to be released on bail in
relation to the aforestated FIR, on such
appropriate terms ...
