O R D E R

Leave granted.

Having regard to the period of incarceration of around 6

years and 5 months undergone by the appellant, Narayan Singh, he is

directed to be released on suspension of sentence during the

pendency of CRA No. 2232/2023 before the High Court of Madhya

Pradesh, Bench at Indore, on the terms and conditions to be fixed

by the trial Court.

In addition to the terms and conditions fixed by the trial

Court, the appellant, Narayan Singh, shall provide one mobile phone

number on which the police officers from the State of Madhya

Pradesh can contact him to ascertain his whereabouts. The

appellant, Narayan Singh, shall surrender the passport issued to

him, if any, in the trial Court and will not leave the State of

Madhya Pradesh without the permission of the trial Court.

The impugned judgment is set aside and the appeal is allowed

in the aforesaid terms.

This order, granting suspension of sentence, may be recalled

in case the appellant, Narayan Singh, remains unrepresented at the

time of hearing the appeal.
