1. Leave granted.

2. The appellant challenges the judgment and order dated

12.12.2025 in Criminal Miscellaneous No.78899 of 2025,

titled “Vijay Shankar Vs. The State of Bihar”, passed by

the High Court of Judicature at Patna.

3. On 23.01.2026, this Court passed the following

order:-

“1. Petitioner challenges the judgment and order dated 12.12.2025, titled “Vijay Shankar vs. The State of Bihar” passed by the High Court of Judicature at Patna in Criminal Miscellaneous No. 78899/2025.

2. Mr. Azmat H. Amanullah, learned counsel, accepts notice on behalf of respondent, State of Bihar. Hence, the formal service of notice on the said respondent is waived.

3. In the meanwhile, the respondent shall file counter affidavit. Rejoinder affidavit thereto, if any, be filed before the next date of listing.

4. We make it clear that no further opportunity will be granted for this

purpose.

5. In the meanwhile, effect and operation of the impugned order date 12.12.2025 passed by the High Court of Patna shall remain stayed.
