Leave granted.
Learned counsel for the respondents acknowledges, that
the present controversy is squarely covered by a decision rendered
by this Court in Criminal Appeal No. 1244 of 2015 (Delhi
Administration vs. Gulshan Kumar), decided on 21.09.2015.
In view of the above, the instant appeal is allowed. The
impugned judgment and order passed by the High Court is set aside,
and the matter is remitted to the High Court for re-consideration,
in consonance with the decision rendered by this Court in Gulshan
Kumar’s case.
