O R D E R

1. The petitioners have filed the captioned transfer petition

under Section 406 of the Criminal Procedure Code, 1973 for transfer

of CC No.206/Jul/2016 filed under Section 506 of the Indian

Procedure Code, 1860, titled as “Sh. Manjeet Ali Mansukhani Vs.

Smt. Suman Manjeet Mansukhani & Ors.” pending in the Court of

learned Metropolitan Magistrate, 10th Court at Andheri, Mumbai to

the Court of learned Chief Judicial Magistrate, Ludhiana, Punjab.

2. Office Report dated 12.12.2023 indicates that the respondent

was duly served, however he has not entered appearance and contest

the case. Having heard learned counsel appearing for the

petitioners and perused the material available on-record and also

the prayer made out in the petition, more so of the reason that the

petitioner No.1 is dependent on her parents at Ludhiana and that

she cannot bear the expenses for travel to the place where the

proceedings are being currently pending i.e. the Court of learned

Metropolitan Magistrate, 10th Court at Andheri, Mumbai, we are of

the view that the Transfer Petition deserves to be allowed.
