1. As per office report, service of the respondent is complete.
However, no one has put in appearance on his behalf.
2. Leave granted.
3. Learned counsel for the appellants has placed reliance on
this Court’s order dated 19th August, 2025 passed in the case of State
of Odisha & Ors. v. Ghanshyam Sahoo (Civil Appeal No.10899 of
2025) and connected matters vide which the bunch of appeals arising
out of an identical issue on merits, were decided. While setting aside
the order passed by the High Court dismissing the Writ Appeals on
account of delay in filing thereof, the matters were remitted back to the
High Court for consideration on merits.

4. In the case in hand delay in filing the intra-court appeal was
258 days. Similar or more were the periods of delay in bunch of
cases, which was condoned by this Court in the aforesaid judgment.
5. For the reasons recorded in Ghanshyam Sahoo’s case
(supra), the impugned order passed by the High Court is set aside.
The matter is remitted back to the High Court for consideration on
merits along with the cases already remitted back.
6. The appeal is accordingly allowed.
