O R D E R

1. Leave granted.

2. We have heard learned counsel for the appellant as well as learned counsel

for the complainant.

3. Two persons were accused and charged with the offence punishable under

Section 307 read with 34 of the Indian Penal Code (for short ‘IPC’). One of the co-

accused was acquitted by the trial Court.

4. The appellant herein was convicted for the offence punishable under Section

307 of the IPC and sentenced for a term of ten years rigorous imprisonment and

fine, by the trial Court. The aforesaid conviction and sentence was upheld by the

High Court. Thus, the present appeal.

5. Learned counsel appearing for the appellant as well as for the complainant

submit that since the complainant and the accused belonged to the same family,

they have settled the matter amicably and have entered into a compromise which

has been signed by both the parties. The complainant has no objection if the

accused is given the benefit of the compromise and is not desirous of contesting

the matter any further.

6. Learned counsel for both sides, accept the compromise, which has been

signed by the parties, who were duly identified.
