Leave granted.
We have heard the learned counsel appearing for
the parties.
It is not in dispute that both the suits are
pending before the same Court, namely, the Principal
Senior Civil Judge and CJM, Davangere.
In our considered view, the High Court has
adopted a hyper technical approach in dismissing the
relief sought. We only say that the interest of
justice would require the suits to be tried
together.
Accordingly, the impugned order is set aside
with a direction to the learned Principal Senior
Civil Judge and CJM, Davangere to try both the suits
being OS No.152/2018 and O.S. No.98/2018 jointly.

The appeals stand allowed, accordingly.
Pending application(s), if any, shall stand
disposed of.
