O R D E R
1. The petitioner (wife) has filed this transfer petition seeking
transfer of H.M.O.P. No. 50 of 2023 titled as “Alla Avinash vs. Raj
Anchal Deva” filed by the respondent-husband under Section 13(1)(i-a)
of the Hindu Marriage Act, 1955, from the court of Additional Senior
Civil Judge Court, Ongole, Prakasam to the court of Family Judge,
South, Saket, New Delhi.
2. As per order dated 24.7.2024 by mutual consent, the parties
were relegated to take recourse of mediation before the Supreme Court
Mediation Centre. As per the report received from the Supreme Court
Mediation Centre, mediation between the parties remained
unsuccessful.
3. Having heard learned counsel for the parties, considering the

distance and the fact that the case is at initial stage, we deem it
appropriate to allow this Transfer Petition and accordingly, H.M.O.P.
No. 50 of 2023 titled as “Alla Avinash vs. Raj Anchal Deva” is ordered
to be transferred from court of Additional Senior Civil Judge Court,
Ongole, Prakasam to the court of Family Judge, South, Saket, New
Delhi.
4. On the request made by the respondent (husband) herein, the
transferee Court shall allow the respondent to appear virtually until
his presence is necessarily required.
