O R D E R
This petition is filed under Section 25 of the Code of Civil
Procedure seeking transfer of H.M.A. No. 2726 of 2023 titled “Ripan
Sarkar vs. Priyanka Sarkar“ pending before the Family Court,
Indore, Madhya Pradesh to the Family Court, Dwarka, New Delhi.
2. The parties were sent for mediation under the orders of this
Court and the mediation was successfully conducted. As per the
report of the Mediator dated 25.11.2024, the parties have
successfully resolved all their disputes. Of course, credit also
goes to the learned Mediator, Ms. Shefali Jain, Advocate, who
endeavoured in undertaking such exercise. The Settlement Agreement
dated 22.11.2024 has been filed by the parties, which is taken on
record and shall form the part of order.
3. We have gone through Settlement Agreement and heard learned
counsel on both sides.
4. In terms of the Settlement Agreement a sum of Rs.13 lakhs was
required to be paid by the respondent-husband to the petitioner-
wife. Indisputably, a sum of Rs.6 lakhs already stood paid to the
petitioner-wife in terms of clauses 4 and 5 of the Settlement
