Leave granted.
We were not inclined to interfere with the impugned judgment.
However, during the course of the hearing, the learned Senior
Advocate appearing for the respondent, on instructions, states that
the respondent, Sattya Sandip Dutta, would pay to the appellant,
Shyamali Dutta, who is his sister, 15,00,000/- (Rupees fifteen₹
lakhs only), subject to her furnishing an undertaking to vacate the
premises in question on or before 28.02.2025.
The learned counsel for the appellant states that the
appellant, Shyamali Dutta, will furnish an undertaking before the
trial Court that she would vacate the premises on or before
28.02.2025.
We take the aforesaid statements made by the learned counsel
for the parties on record.
The appellant, Shyamali Dutta, shall file her undertaking on
or before 03.01.2025. In case there is a breach of the said
undertaking, she will be proceeded against in accordance with the

law, including the law relating to contempt of court.
The respondent, Sattya Sandip Dutta, shall deposit
15,00,000/- (Rupees fifteen lakhs only) before the trial court on₹
or before 04.02.2025. Intimation with regard to the said deposit
