1. Leave granted.
2. Heard Mr. Ravi Bakshi, learned counsel appearing for the
appellant (Insurance Company). The respondent Nos. 1 to 4
(claimants), are represented by Ms. Chandni Gubbi, learned counsel.
3. The claim here arise out of the death of Ramesh Kumar, who
died in a road accident on 31.03.2014. On that date, the car
driven by the victim was hit by a tempo, driven by the owner-cum-
driver (respondent No. 5). The legal heirs of the deceased (Ramesh
Kumar) claimed Rs.5 crore compensation before the MACT at Bengaluru
under Section 166 of the Motor Vehicles Act by projecting that the
victim at the relevant time, was employed as a Deputy General
Manager (Production), in Micro-Labs Limited, Bangalore.
4. In support of the claim, the claimants have produced the
appointment letter, the salary certificates and bank balance. The
victim’s employment status is also founded on the evidence of the
Senior Vice President, Human Resources at Micro-Labs Limited, who
deposed as witness (PW-3). The relevant documents were produced by
the employer’s witness and were accordingly exhibited.
