CIVIL APPEAL NO. 3294 of 2012
SARASWATI PRADAD SINGH PETITIONER(s)/
APPELLANT
VERSUS
ABDUL REHMAN (DEAD) BY LRS. RESPONDENT(s)/
CONTEMNORS
O R D E R
We have heard learned counsel on the issue of sentence.
We have given an opportunity on 16.12.2020 for the two
contemnors to redeem themselves but they have only transmitted the
amount and not handed over vacant and peaceful possession and again
an argument is raised that the possession is not with them.
We thus consider it appropriate to sentence the two contemnors
to three months simple imprisonment and a fine of Rs.2,000/- each
and failing payment of fine for a further sentence of 15 days.
We also direct the local police station of the Sultan Bazar,
Hyderabad to break open any lock and handover possession of the
suit premises to the petitioner/appellant.
2
The contemnors are granted three days’ time to surrender
before the local police station and to be taken into custody and
serve out their sentence.
The contempt petition stands deposed of.
