1. Leave granted.
2. Heard learned counsel appearing for the parties.
3. The Order under challenge is very unusual order
dated 09.04.2024, which is passed by the High Court of
Judicature at Patna in Criminal Miscellaneous Petition No.
26818 of 2024, wherein on the very first day of hearing,
without issuing any notice to the respondent-State or to
the present appellant-complainant, the High Court has
granted anticipatory bail to the respondent no.2-accused,
namely, Rajesh Pandey @ Rajesh Kumar Pandey, involved in
the FIR registered for offence punishable under Sections-
467,471,488 and 120/34 of the Indian Penal Code.
4. Vide the order passed on 03.12.2024, this Court had
asked the learned counsel appearing for the respondent-
State to take instructions as to whether the concerned
AGP/APP in the case was heard by the High Court before
passing the impugned order. Today, he has stated that
though, one APP was present in the Court, he had not made

any submission as he did not have any instructions, and he
was not heard.
